Membership and cancellation terms

A plain summary of the commercial terms. Where a term is still being finalised it is marked, rather than described vaguely.

This page is a summary for prospective agents. The binding terms are those in the signed independent contractor agreement between you and CapTex Realty. Where the two differ, the signed agreement governs.

Fees

  • $100 per month membership.
  • $99 broker-compliance fee on each closed transaction.
  • No percentage commission split, no desk fee, no franchise fee, no monthly transaction minimum.
  • No annual plan is currently offered.

What you pay separately

MLS dues, REALTOR® association dues, lockbox and Supra key fees are held in your name and billed to you directly by those organizations. Your own business costs, including marketing, CRM, photography, signage, licence renewal and continuing education, are yours. These are not CapTex fees.

Qualification and approval

Membership is not open to self-service purchase. You apply, have a 15-minute fit call, and membership begins only if CapTex approves the application and you sign the independent contractor agreement. CapTex may decline an application.

Billing

Owner to confirm before publication: billing start date relative to approval, billing cycle and renewal date, accepted payment methods, what happens on a failed payment, and any grace period before sponsorship is affected.

Cancellation

Owner to confirm before publication: the notice period required to cancel, whether a final partial month is prorated or charged in full, and the process for requesting cancellation.

What is settled: membership is month to month and there is no long-term contract or early-termination penalty.

If you leave

Your listings go with you, automatically. There is no release fee, and CapTex takes no cut of your future commission on them.

Still being confirmed: how a transaction that is already under contract but not yet closed is handled at the point of departure, including which brokerage closes it and whether the $99 fee applies to it.

Errors and omissions insurance

CapTex Realty carries E&O covering your transactions and pays the premium. There is no E&O charge to you. If a claim is made on one of your transactions, the deductible of $2,500 per claim is the agent's responsibility.

Independent contractor status

CapTex agents are independent contractors, not employees. Membership does not create employment, and CapTex does not pay a salary, wage or draw. You are responsible for your own taxes, insurance beyond the brokerage's errors and omissions coverage, and your own business expenses.

No income representation

Nothing on this website, including the calculator and the comparison tables, is a projection of earnings, a statement of typical results, or a guarantee of income. Figures shown are illustrative and depend on assumptions stated alongside them.
